What is an EU trademark (EUTM)?
An EU trademark (EUTM) is a single trademark registration that protects your brand across all 27 EU member states simultaneously. It's filed through EUIPO (European Union Intellectual Property Office) based in Alicante, Spain. One filing, one fee, one registration — valid everywhere from Portugal to Finland.
How long does the registration take?
Fast Track filing (using pre-approved TMclass descriptions): approximately 4-6 weeks to publication, then a 3-month opposition period. If no one opposes, registration is typically complete in 5-6 months total. Standard filing may take 8 weeks to publication.
What can I trademark?
Word marks (brand names, slogans), figurative marks (logos, designs), combined marks (name + logo), 3D shapes, colors, sounds, and patterns. The mark must be distinctive and not purely descriptive of your goods or services.
What is the Nice Classification?
The Nice Classification is an international system that categorizes all goods and services into 45 classes (1-34 for goods, 35-45 for services). When registering a trademark, you must specify which classes your mark will cover. The base EUIPO fee covers 1 class, with additional classes at €50 each.
What is the SME Fund and am I eligible?
The SME Fund ("Ideas Powered for Business") is an EU grant program that reimburses up to 75% of EUIPO trademark filing fees (maximum €700). Eligible applicants are EU-based SMEs: fewer than 250 employees and either under €50 million turnover or under €43 million balance sheet total. The fund runs through December 2026 with a €60 million budget.
Do I need to be in the EU to register?
EU/EEA-based individuals and companies can file directly. Non-EU applicants need an EEA-based representative. Either way, we handle the filing. If you already have an EU-based company or are forming one, the process is straightforward. If not, we can arrange representation.
How long does the protection last?
An EUTM is valid for 10 years from the filing date and can be renewed indefinitely for additional 10-year periods. The renewal fee is €850 for one class.
